Vivet Apparel LLC, doing business as "VIVET" ("VIVET," "we," "us," and "our"), values the privacy of the individuals who visit and use our website. This Privacy Policy ("Policy") explains how we collect, use, disclose, and protect information when you visit vivetofficial.com, including the homepage and cookie layer, product pages, cart and checkout, account and order/tracking pages, the returns portal, customer-service and contact interfaces, email/SMS sign-up forms, and any creator or influencer submission portal or form, or any other website or online service that we operate and that links to this Policy (collectively, the "Site" or "Services").

This Policy applies to information collected through the Site, including through online forms, account registration and login, order placement and checkout, customer-service communications, and marketing sign-ups. This Policy does not apply to information collected offline or through other channels unless we expressly state that this Policy applies, nor does it apply to third-party websites, platforms, services, or applications that are not operated by VIVET, even if linked from the Site.

By using the Site, you acknowledge that you have read this Privacy Policy. If you do not agree with our privacy practices as described in this Privacy Policy, you may choose not to use the Site.

We may update this Privacy Policy from time to time. If we make material changes, we will provide notice as required by law.

Throughout this Policy, we refer to the term "Personal Information." "Personal Information" means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with an individual or household. Depending on the law that applies, similar terms such as "personal data" or "personally identifiable information" may be used. Personal Information does not include publicly available information, de-identified information, or aggregated information that cannot reasonably be used to identify a particular individual.

Information We Collect or Process:

When you use or access the Site, we may collect Personal Information directly from you, such as the following:

• Identifiers and contact information, such as your name, email address, mailing address, and phone number.

• Information you submit through online forms, including account registration, checkout, contact, and customer-service forms, and the contents of any message or inquiry you submit.

• Order and transaction information, such as items purchased, order history, billing information, and returns/exchanges. VIVET does not directly collect or store full payment-card numbers; payment information is collected and processed by our third-party payment processor.

• Account registration and login information, such as your username, password or other login credentials, and your account settings, activity, and preferences.

• Mobile telephone number and related information you provide if you sign up to receive text (SMS) messages from us, together with your associated consent and communication preferences.

• Marketing preferences, such as whether you sign up to receive emails, texts, or other communications from us.

• Information voluntarily submitted through a creator, influencer, or other brand submission form, such as your name, contact information, social media handles, and information about your content or audience.

• Other information you choose to provide to us.

We do not intentionally request or collect sensitive Personal Information such as racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data, health data, or information concerning sex life or sexual orientation as part of our ordinary e-commerce operations. If the Site allows account creation, authentication information may be processed to create, secure, and administer your account. Payment-card information and other complete payment credentials are collected and processed by our third-party payment processors and checkout providers, not directly by VIVET, as described in the Payment Processing section below.

We also may collect certain information automatically when you visit the Site, including information about the device, browser, and network that you use to access the Site. This may include:

• Internet Protocol (IP) address;

• Browser type and version, and device identifiers;

• Operating system;

• Pages visited and interactions with the Site;

• Referring URLs and referral source;

• Date and time of visit; and

• General geographic location derived from IP address or similar technical data.

We may collect this information through cookies, pixels, web beacons, log files, and other similar technologies. We use this information to operate, secure, maintain, personalize, improve, analyze, and optimize the Site and our business operations.

Online Accounts

If the Site allows you to create an online account, we may collect and process information associated with that account, such as your name, email address, phone number, shipping and billing addresses, username, password or other login credentials, account settings, saved preferences, order history, returns and exchanges, wish lists or saved items, and communications related to your account. We use this information to create, administer, authenticate, secure, and support your account; provide account-related features; help you manage orders, returns, exchanges, and preferences; prevent fraud or unauthorized access; and communicate with you about your account. You are responsible for maintaining the confidentiality of your login credentials and for limiting access to devices on which you remain signed in.

Cookies and Tracking Technologies

Cookies are small text files stored on a device when a user visits a website, and pixels (sometimes called web beacons) are small pieces of code that help websites recognize user activity, measure engagement, and support website functionality, analytics, and communications. On the Site, we may use one or more of the following types of cookies or similar technologies:

• Strictly Necessary Cookies: used to provide the Site, support account login, maintain your shopping cart, process checkout, prevent fraudulent activity, and administer the Site. These are always active.

• Functional and Preference Cookies: used to remember your preferences and settings and to provide enhanced functionality.

• Performance and Analytics Cookies: used to collect information about how visitors use the Site, such as through Google Analytics, Google Search Console, and similar tools.

• Targeting or Advertising Cookies: placed by us or our third-party partners, including Google and Meta technologies, to deliver, measure, and personalize advertising, including retargeting, on and off the Site.

• Social Media Cookies: set by social media services that we have added to the Site to enable you to engage with us or share content through social media platforms.

You can manage or block cookies through your browser or device settings, and where offered, through the Site's cookie-consent tool. Blocking or disabling certain cookies may affect Site functionality.

Categories of Personal Information We Collect

Depending upon your relationship with us, the following is a list of Personal Information that we may have collected from consumers within the last 12 months through the Site:

SMS and Email Marketing Program

If you provide your mobile telephone number and agree to receive text messages, we, and service providers acting on our behalf, including Klaviyo, may send you SMS or text messages, such as order or account notifications, service-related messages, responses to your requests, and, where you have separately consented, marketing or promotional messages. We send text messages only as permitted by applicable law, including the Telephone Consumer Protection Act and applicable state laws, and, where required, based on your prior express consent. Your consent to receive marketing text messages is not a condition of purchasing any goods or services.

Message frequency may vary, and message and data rates may apply depending on your mobile plan. You may opt out of text messages at any time by replying STOP to any message you receive from us, and you may reply HELP for assistance. We do not sell or share mobile telephone numbers or SMS consent with third parties for their own independent marketing purposes.

Third-Party Service Providers, Marketing, and Advertising

We use third-party technologies, plugins, integrations, and service providers to support the operation, security, functionality, performance, analytics, communications, and marketing activities of the Site, including Shopify (e-commerce/storefront and checkout), Klaviyo (email/SMS marketing and segmentation), Gorgias (customer service), AfterShip (shipping, tracking, and returns/exchanges), payment and fraud-prevention processors, shipping carriers, and Google and Meta technologies (analytics and advertising). These technologies may collect information directly from your browser or device and may use cookies, pixels, web beacons, scripts, or similar technologies. Information collected through these technologies may be processed in accordance with the applicable third party's privacy policy.

We do not control third-party tracking technologies or how third parties may use information collected through such technologies. Payment Processing

When you make a purchase through the Site, payment information is collected and processed by our third-party payment processors and checkout providers. VIVET does not directly collect, receive, or store your full payment-card number, card security code, or other complete payment credentials. We may receive limited transaction-related information, such as your name, billing address, shipping address, email address, phone number, order details, payment status, payment method type, limited payment-card details such as the last four digits of a card, and fraud-prevention or verification information, as necessary to process and fulfill your order, provide customer support, manage returns and exchanges, prevent fraud, maintain records, and comply with legal obligations. Payment processors and checkout providers process payment information in accordance with their own privacy policies, security practices, and applicable payment-card industry requirements.

Managing and Blocking Cookies

Through browser settings, you can manage or block the use of cookies. In addition, you may be able to use opt-out tools for ad networks and firms who participate in the Network Advertising Initiative at http://optout.networkadvertising.org or the Digital Advertising Alliance at http://optout.aboutads.info.

To effectively manage cookies through browser settings or ad industry opt-out tools, you must set your preferences on all browsers and all devices that you use. If you clear your browser cache or cookies, you may need to reset your preferences.

Your Choices

You may choose not to provide the Personal Information we request through the Site, though this may limit your ability to use certain Site features (for example, completing a purchase). You may also restrict certain collection of Personal Information through your device or browser settings, including by disabling cookies, but doing so may prevent or impair Site functionality.

Some Internet browsers have a “do-not-track” feature that lets you tell websites that you do not want to have your online activities tracked. At this time, the Site does not respond to browser “do-not-track” signals. 

We recognize and honor opt-out preference signals, including the Global Privacy Control (GPC). GPC is a browser- or extension-based signal that communicates your privacy preferences to the websites you visit. When we detect a GPC signal from your browser or device, we treat it as a valid request to opt out of the “sale” of Personal Information, the “sharing” of Personal Information for cross-context behavioral advertising, and the processing of Personal Information for targeted advertising, in each case as those terms are defined under applicable state privacy laws and to the extent such laws apply to us. Because opt-out preference signals are tied to a specific browser or device, you must enable GPC on each browser and device you use, and if you clear your cookies or use a different browser or device, you may need to enable the signal again. How and Why We Use Your Information

We may use, disclose, transmit, transfer, store, and otherwise process the information described in the Information We Collect or Process section for various purposes, including:

• Providing, developing, maintaining, protecting, and improving the Site or Services and our business operations.

• Responding to your inquiries, online form submissions, requests for information, or other communications.

• Processing, fulfilling, and managing your orders, transactions, and requests submitted through the Site or Services, including billing, order support, customer service, and coordinating payment processing through our third-party payment processor.

• Sending you text (SMS) messages and email marketing communications that you have requested or consented to receive, as described in the SMS and Email Marketing Program section above.

• Creating, administering, authenticating, and securing customer accounts, and providing account-related features, communications, and support.

• Managing and maintaining customer relationships, order support, and service-related communications.

• Operating, evaluating, debugging, identifying and repairing errors, and improving our Site, services, communications, and marketing materials.

• Understanding how visitors use the Site or Services, performing analytics, analyzing and reporting on Site usage and performance, and determining what content, products, features, or services may interest our visitors and customers.

• Managing advertising and marketing activities, including providing product updates, newsletters, announcements, promotions, and other communications that may interest you.

• Storing information about your preferences and recognizing you when you use the Site or Services.

• Creating aggregate, anonymized, or deidentified data.

• Maintaining the safety, security, and integrity of the Site or Services, our technology assets, our organization, and our business.

• Protecting against malicious, deceptive, fraudulent, or illegal activity, including by using security tools and anti-spam, anti-abuse, and bot-detection technologies.

• Enforcing our policies, terms of use, contracts, or other legal rights.

• Evaluating or participating in an actual or potential merger, divestiture, restructuring, reorganization, dissolution, acquisition, financing, or other sale or transfer of some or all of our assets.

• Complying with law and legal obligations.

We use Personal Information for the purposes described in this Policy, for purposes disclosed at or before the time of collection, and for other purposes authorized by applicable law or with your consent where required.

Our employees, advisors, contractors, and agents may access Personal Information as necessary to perform their duties and support our business operations. Access is limited to those with a legitimate business need and subject to appropriate confidentiality and security obligations.

Social Media Features and Links

The Site may include links to our social media pages or other social media features. If you choose to interact with those features or visit a third-party social media platform through the Site or Services, information may be collected and processed by the applicable platform in accordance with its privacy policy and terms of use. We do not control the privacy or data-handling practices of third-party platforms and encourage you to review their policies before providing information or interacting with their services

Disclosure of Your Personal Information

We do not sell, rent, or lease Personal Information for monetary compensation. To the extent our use of cookies, analytics, advertising, or similar technologies is considered a “sale,” “sharing,” or use for targeted advertising under applicable privacy laws, you may opt out by using our cookie-consent tool, by sending an opt-out preference signal such as the Global Privacy Control, or by contacting us using the information below. We may disclose Personal Information as follows:

• To our service providers, including Shopify, Klaviyo, Gorgias, AfterShip, payment and fraud-prevention processors, and shipping carriers, who help us operate, secure, host, analyze, and improve the Site and fulfill orders;

• To advertising and analytics partners, including Google and Meta, for measurement, retargeting, and advertising purposes — this disclosure may constitute a “sale” or “sharing” of Personal Information for cross-context behavioral advertising under certain state privacy laws, as described further below;

• To comply with applicable law, legal requirements, and industry standards;

• To enforce our Terms of Use and other policies, and to detect, prevent, or address fraud, security, or technical issues;

• To protect the legal rights, property, safety, and security of VIVET, our users, and others; and

• In connection with an actual or potential merger, acquisition, financing, reorganization, dissolution, sale, or transfer of some or all of our assets, subject to appropriate confidentiality protections.

In the preceding 12 months, the following categories of Personal Information may have been disclosed for a business purpose to the categories of third parties described above:

California Shine the Light Law

Pursuant to California Civil Code Section 1798.83, California residents may request and obtain from us, once per calendar year, free of charge, information about the Personal Information we shared, if any, with third parties for their direct marketing purposes in the preceding calendar year. If you would like to make such a request, please use the contact information in the Contact Information section below and include the subject line “CA Shine the Light.”

Children's Information

The Site is not directed to children, and we do not knowingly collect Personal Information from children under thirteen (13) years of age. If you are a parent or guardian and believe your child has provided us with Personal Information without your consent, please contact us using the information in the Contact Information section below, and we will take appropriate steps to delete such information.

Cross-Border Processing

VIVET is based in the United States and currently offers shipping to customers in the United States, including U.S. territories where shipping is supported, and Canada. If you access the Site, place an order, or otherwise interact with us from Canada or another location outside the United States, your information may be transferred to, stored in, accessed from, or otherwise processed in the United States and in other jurisdictions where we or our service providers operate. For example, we and our service providers may process information across borders to operate the Site, process payments, fulfill orders, provide customer support, manage returns and exchanges, deliver marketing communications, prevent fraud, and maintain the security of the Site. The privacy and data-protection laws in these jurisdictions may differ from those in your province, state, or country of residence, and Personal Information processed outside Canada may be accessible to courts, law enforcement, regulators, or other governmental authorities in those jurisdictions in accordance with local law. Where required by applicable law, we use appropriate contractual, technical, and organizational safeguards for cross-border processing of Personal Information.

Your Rights in Relation to Your Personal Information

You may have certain legal rights in relation to our use of your Personal Information. A number of U.S. states provide individuals with rights regarding their Personal Information, including California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, Virginia, and other jurisdictions that may adopt similar laws. Canadian residents may also have rights under Canadian federal or provincial privacy laws, including the Personal Information Protection and Electronic Documents Act (“PIPEDA”), where applicable. • Viewing and obtaining a copy of the Personal Information we maintain about you;

• Correcting or amending Personal Information we maintain about you;

• Having Personal Information we maintain about you deleted, erased, or forgotten;

• Opting out of the processing of Personal Information for targeted advertising;

• Opting out of the sale of Personal Information;

• Opting out of the sharing of Personal Information for cross-context behavioral advertising, where applicable;

• Opting out of profiling in furtherance of decisions that produce legal or similarly significant effects concerning you, where applicable;

• Restricting or limiting certain uses or disclosures of sensitive Personal Information, where applicable;

• Obtaining a portable copy of certain Personal Information;

• Appealing the denial of a request, where applicable;

• Filing a complaint with us or the appropriate governmental entity.

Some states require specific information regarding our practices and your rights to be provided in the form of a privacy notice. These notices are provided in the State Specific Notices section below.

We may require that you verify your identity before exercising your individual rights. In most circumstances, individual rights are not absolute, and where applicable law permits or requires, we may choose to limit or deny a request. If we limit or deny a request, we will provide an explanation in writing where required by law. We will respond to your request within the time period required by applicable law. If we need additional time, we will inform you of the reason and extension period in writing where required by law.

Canadian Privacy Rights

If you are located in Canada, this Policy is intended to provide notice regarding our collection, use, disclosure, and cross-border processing of Personal Information under PIPEDA and other applicable Canadian privacy laws. Subject to applicable law and limited exceptions, you may request access to the Personal Information we maintain about you, request that inaccurate or incomplete Personal Information be corrected, withdraw consent to certain processing where our processing is based on consent, and ask questions or submit complaints about our privacy practices. You may submit these requests using the contact information below. We may need to verify your identity before responding to a request, and withdrawing consent may limit our ability to provide certain products, services, account features, order support, or marketing communications.

State Specific Notices:

Depending on your location and subject to applicable law, you may have the right to request confirmation of whether we process Personal Information relating to you, and if so, to request a copy.

California Privacy Rights (CCPA/CPRA)

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the “CCPA”), gives you additional rights regarding your Personal Information, including the rights described above. This section supplements the rest of this Policy and applies only to California residents.

The categories of Personal Information we collect, the categories of sources, the business and commercial purposes for which we collect and use it, and the categories of third parties to whom we disclose it are described in the Information We Collect or Process, How and Why We Use Your Information, and Disclosure of Your Personal Information sections above.

Sensitive Personal Information. We do not intentionally request or collect sensitive Personal Information through the Site as part of our ordinary e-commerce operations, except to the extent you voluntarily provide such information in a message, inquiry, or other communication, or to the extent certain account authentication or payment-related information is processed by our service providers as described in this Policy. Payment-card information and other complete payment credentials are collected and processed by our third-party payment processors and checkout providers, not directly by VIVET. If we process sensitive Personal Information, we use and disclose it only for purposes permitted by the CCPA or as otherwise authorized by you. We do not use sensitive Personal Information for the purpose of inferring characteristics about you.

Your California rights. Subject to certain exceptions, you have the right to know and access the Personal Information we have collected about you; to delete your Personal Information; to correct inaccurate Personal Information; to opt out of the “sale” or “sharing” of your Personal Information; to limit the use and disclosure of sensitive Personal Information where applicable; and not to receive discriminatory treatment for exercising your rights.

We do not sell your Personal Information for monetary consideration. To the extent our use of advertising, analytics, cookies, pixels, tags, or similar technologies constitutes “sharing” or a “sale” under the CCPA, you may opt out through our cookie-consent tool, an opt-out preference signal such as the Global Privacy Control, or by contacting us using the information below.

How to exercise your rights. You may submit a request using the contact information in the Contact Information section, and you may use an authorized agent to submit a request on your behalf where permitted by law. We will verify your identity and respond within the time required by the CCPA.

Nevada Privacy Rights

Nevada residents may submit a verified request directing us not to sell certain covered information, as defined under Nevada law. VIVET does not currently sell covered information as defined under Nevada law. To submit such a request, contact us using the information below with the subject line “Nevada Privacy Request.”

Security and Retention

We rely on the security measures of our primary service providers, including Shopify, Klaviyo, Gorgias, AfterShip, payment processors, and shipping carriers, each of which maintains its own security program, encryption, access controls, and contractual/privacy safeguards. Access to Personal Information within VIVET is limited to personnel with a legitimate business need, using role-based permissions and administrative controls. Unfortunately, no data transmission or information system can be guaranteed to be 100% secure, and we cannot guarantee or warrant the security of any information you transmit to us.

We retain Personal Information only as long as reasonably necessary for the purposes described in this Policy and to satisfy legal, accounting, tax, fraud-prevention, dispute, and contractual obligations. 

Third-Party Links

The Site may include links to other websites, applications, or services provided by third parties, including our service providers' own platforms. We are not responsible for the privacy policies or practices of those third parties, and we encourage you to review their policies before providing information to them.

Policy Updates

We may update this Policy from time to time to reflect changes in our practices. When we do, we will update the “Last Modified” date above and, for material changes, provide notice as required by law.
